Terms & Conditions

QuickLeads sells access to public foreclosure filings and appended owner contact information. These terms cover what you may do with that data, how billing works, what we do and do not promise about accuracy, and who carries which risk.

Effective

1Who these terms are between

QuickLeads LLC (“QuickLeads”, “we”, “us”) is a California limited liability company at 8605 Santa Monica Blvd #368000, West Hollywood, CA 90069. It operates the site at quickleadsllc.org and the portal at app.quickleadsllc.org.

By creating an account, subscribing, or using the site or the portal, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it, and “you” means that company. If you do not agree, do not use the service.

These terms incorporate our Privacy Policy and our Refund Policy.

2What the service is

QuickLeads collects Notices of Default, Notices of Trustee’s Sale and related filings recorded by California county recorders, extracts the filing details, appends owner contact information from third-party data providers, and delivers the result through the portal, spreadsheet export, email, a map view and a calendar feed.

The plans and what each includes are set out on the pricing page. On every plan a subscriber sees a filing on the day we obtain it, which for most filings is the business day after it is recorded and for some is the day itself. There is no free plan.

County coverage, delivery timing, included fields and data sources are described capabilities, not contractual commitments, and may change as counties, recorders and data providers change. We will not materially reduce what a paid plan delivers without notifying subscribers by email.

3Accounts

You must be 18 or older and provide accurate account information. You are responsible for everything done under your account and for keeping your sign-in credentials secure. Tell us promptly if you believe your account has been accessed by someone else.

A subscription is for one person. Accounts may not be shared, and credentials may not be issued to contractors, virtual assistants, partners or anyone outside the subscribing individual. Where we see one subscription plainly being used by a team, we will contact you to move the account to the right number of seats; if that is not resolved, we may suspend the account under section 8.

4Subscriptions, billing and cancellation

Paid plans are sold per county, per month. Buying a plan in one county grants nothing in another. Prices are shown on the pricing page and at checkout, and the price charged is the price displayed at checkout.

Each county begins with a free trial, 7 days unless an offer link you used states a different length, run by Stripe with a card on file. The end date is shown at checkout and on your billing page, and you are not charged if you cancel before it. After the trial, plans are billed in advance through Stripe and renew automatically each month until cancelled. We do not store card details; Stripe does.

You can cancel at any time from the billing page. Cancellation stops future charges and takes effect at the end of the period already paid for; access continues until then. Counties cancel independently of one another.

Subscriptions are not refundable. The full policy, including the narrow exceptions for billing errors and outages on our side, is on the Refund Policy page.

We may change prices. Existing subscribers are notified by email at least 30 days before a change takes effect on their subscription, and may cancel before it does.

California Automatic Renewal LawRenewal terms, price and billing interval are presented clearly before purchase, an acknowledgement with cancellation instructions is emailed after purchase, and cancellation is self-service in the portal in no more steps than signing up took.

5How you may use the data

This is the section that matters most. The data describes real people in financial distress, and how you contact them is regulated.

You are responsible for your own outreach compliance. That includes the federal Telephone Consumer Protection Act, the National Do Not Call Registry, state telemarketing and mini-TCPA rules, CAN-SPAM for email, and any state licensing that applies to what you do with a lead. QuickLeads flags numbers found on the Do Not Call registry and numbers associated with known TCPA litigators as a courtesy. Those flags are not complete, are not guaranteed, and are not a determination that any unflagged number is safe to call.

You may not:

  • resell, sublicense, syndicate, republish or otherwise redistribute the data, in whole or in part, whether or not for a fee;
  • share your account or the data with anyone outside your subscription;
  • scrape the portal, bulk-download beyond the export tools we provide, or access the service by automated means;
  • use the data to harass, intimidate, defraud or mislead a property owner, or to make any communication that misrepresents who you are;
  • use the data for any purpose governed by the Fair Credit Reporting Act, including credit, employment, insurance or tenant screening. This is not a consumer report and QuickLeads is not a consumer reporting agency;
  • attempt to identify, re-identify or enrich individuals in the data for any purpose other than contacting them about a property transaction.

What happens to data you exported. Your licence to the data is tied to an active subscription. When a county subscription ends, you may continue working the specific leads you were already pursuing, but you may not use exported QuickLeads data to build, sell or continue a general marketing list, and you must delete exported files that are no longer tied to an active pursuit within 30 days of cancellation. On request, tell us in writing that you have done so.

If a person named in the data asks us to delete their information, we will honour that request and we may require you to do the same for copies you hold.

6What we do not promise about accuracy

Filings come from county records and third-party data providers. QuickLeads does not independently verify them. Addresses, amounts, party names and contact details may be wrong, stale, or attached to the wrong person.

Trustee sale dates move. Postponements and cancellations are routine and are not always re-recorded, so a sale shown as scheduled may not happen. Projected Notice of Default windows shown in the portal and on the calendar feed are estimates computed from the California statutory minimum, not dates taken from any document. Verify with the trustee before acting on any date.

The service and the data are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in QuickLeads is legal, financial, tax or real estate advice.

7Our intellectual property

The portal, the site, the software behind them and our compilation, extraction and arrangement of the data are ours or our licensors’. Individual public records are not owned by anyone; the compilation is.

Your subscription is a limited, non-exclusive, non-transferable, revocable licence to access and use the service for your own internal business purposes while the subscription is active. It ends when the subscription does.

8Suspension and termination

We may suspend or close an account for non-payment, for a breach of section 3 or section 5, or where we reasonably believe the data is being used unlawfully or in a way that endangers a property owner.

Except where the breach is serious or ongoing, we will give you notice describing the problem and seven days to fix it before suspending. Where we close an account for a reason other than your breach, we refund the unused prepaid portion of the period. Where we close it for breach, we do not.

You may close your account at any time from the portal. Sections 5, 6, 7, 9, 10 and 11 survive termination.

9Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost deals, lost revenue or loss of data, whether or not the possibility was known.

Our total aggregate liability arising out of or relating to these terms or the service is limited to the amounts you paid QuickLeads in the twelve months immediately before the event giving rise to the claim.

These limits do not apply to a party’s gross negligence or wilful misconduct, to your obligations under section 5, to your indemnity under section 10, or to any liability that cannot be limited by law. Some jurisdictions do not allow certain limitations, in which case the limits apply to the greatest extent permitted.

10Indemnity

You will defend, indemnify and hold harmless QuickLeads and its members, officers and employees from any claim, demand, penalty, fine, loss or expense (including reasonable legal fees) arising out of:

  • your communications with any person identified through the service, including any claim under the TCPA, the Do Not Call Registry, a state telemarketing or mini-TCPA statute, CAN-SPAM, or an unfair or deceptive practices law;
  • your use of the data in breach of section 5;
  • any transaction you enter into with a property owner;
  • your breach of these terms or of any law.

Statutory damages for calling a listed number are assessed per call. This clause exists because that exposure belongs to whoever placed the call.

11Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

Talk to us first. Before either of us files anything, the one with the complaint will describe it in writing to the other and give them 30 days to put it right. Write to Cody@quickleadsllc.org, or to the postal address at the foot of this page. Almost everything ends here, and this step is a condition of bringing a claim, not a suggestion.

If that fails. Any dispute arising out of or relating to these terms or the service is brought exclusively in the state or federal courts sitting in Los Angeles County, California. Both parties consent to personal jurisdiction there and waive any objection based on inconvenient forum.

Small claims stays open. Either party may instead bring an individual claim in a small claims court with jurisdiction, and nothing above prevents either party from seeking an injunction to stop misuse of the data or of our intellectual property while a dispute is being resolved.

What we have not done. These terms contain no mandatory arbitration clause and no class-action waiver. If you have a dispute with us, you keep your right to a court, to a jury, and to join others with the same complaint. We would rather earn the absence of disputes than contract our way out of them.

Each party pays its own costs unless a court orders otherwise. Any claim must be brought within one year of when the claiming party first knew, or reasonably should have known, of the facts giving rise to it.

12Changes

We may update these terms. Material changes are notified by email to the address on your account before they take effect, and the effective date at the top of this page changes. Continuing to use the service after that date means you accept the new terms. If you do not, cancel before they take effect.

13General

These terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between us on this subject. If any provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement without our written consent; we may assign it in connection with a merger, acquisition or sale of assets. Nothing here creates a partnership, agency or employment relationship.
